BowerNest owns the platform, its design, code, and branding. When you submit content (like your profile or feedback), you keep ownership but give us permission to use it to run the service. You cannot copy, reproduce, or use BowerNest's branding or content without permission. If you believe someone is infringing your intellectual property on our platform, contact us and we will investigate.
1. BowerNest Intellectual Property
All intellectual property rights in and to the BowerNest platform, including but not limited to the website, software, algorithms, user interface, design elements, graphics, logos, trademarks, trade names, service marks, and all associated content, are owned by or licensed to BowerNest Australia Pty Ltd. These rights are protected by Australian and international intellectual property laws, including the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth), and the Designs Act 2003 (Cth).
2. User Content
Users retain ownership of any original content they submit to the platform ("User Content"). By submitting User Content, you grant BowerNest a non-exclusive, royalty-free, worldwide, transferable, and sublicensable licence to use, reproduce, modify, adapt, publish, display, and distribute your User Content for the purposes of operating, promoting, and improving the Service.
This licence continues for as long as your User Content remains on the platform and for a reasonable period after its removal, to account for cached or archived copies. You may request deletion of your User Content at any time by contacting us.
3. Feedback and Suggestions
Any feedback, suggestions, ideas, or recommendations you provide to BowerNest regarding the Service ("Feedback") shall be the exclusive property of BowerNest. You hereby assign all rights, title, and interest in any Feedback to BowerNest, and BowerNest shall be free to use, disclose, reproduce, licence, and otherwise exploit the Feedback without restriction or obligation to you.
4. Restrictions
Unless expressly authorised by BowerNest in writing, you must not:
- copy, reproduce, modify, or create derivative works of any part of the Service or its content;
- distribute, publicly display, or publicly perform any content from the Service;
- reverse engineer, decompile, or disassemble any software or technology used in the Service;
- use BowerNest's trademarks, logos, or branding without prior written consent;
- remove, alter, or obscure any copyright, trademark, or other proprietary notices; or
- use any data mining, robots, or similar data gathering or extraction methods on the Service.
5. Trademark Usage
"BowerNest", the BowerNest logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BowerNest Australia Pty Ltd. You must not use these marks without the prior written permission of BowerNest. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.
6. Infringement Reporting
If you believe that any content on the BowerNest platform infringes your intellectual property rights, please contact us at [email protected] with the following information:
- a description of the intellectual property right you claim has been infringed;
- a description of the material you claim is infringing and its location on the platform;
- your contact information (name, address, telephone number, and email address);
- a statement that you have a good faith belief that the use of the material is not authorised by the intellectual property owner, its agent, or the law; and
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the intellectual property owner or authorised to act on the owner's behalf.
BowerNest will investigate all valid reports and take appropriate action, which may include removing or disabling access to the allegedly infringing material.
